They govern the legal relationship between the internet user and the transport company within the website it publishes at https://tunisiecolis.com. Access to the services requires the user to read all the terms and accept them without reservation. The terms may be amended at any time; users are advised to check the website and review them regularly.

Article 2 — General operation and scope

Under Law No. 2000-83 of 9 August 2000, the necessary information and prices for services offered online are clearly communicated on the website.

The customer confirms having read these terms of sale before validating an order and accepting them in full without exception.

The platform recommends downloading and preferably printing the contract to keep a reference copy.

The terms may be changed at any time. Users should visit the website regularly to stay informed of any updates.

Communication between the platform, transport company, carrier and customer should take place online, although the parties may agree to another method, such as telephone or post.

Article 3 — The transport provider’s terms and conditions

The selected transport provider’s terms of sale apply to every stage, including collection and delivery. They are available on the provider’s website. If they conflict with any provision of these terms, the transport provider’s terms take precedence.

Article 4 — Website access

Accessing and browsing https://tunisiecolis.com implies prior and unreserved acceptance of these terms of use.

Additional insurance must be requested specifically when placing the order, with payment of the applicable commission based on the insured shipment value. This insurance is available only for new goods.

Compensation depends on the value insured at the outset. If the full value is covered, compensation is complete within the cover conditions. If the insured amount is lower than the value that should have been insured, compensation is not complete.

Article 8 — Claims procedure

Claims must be sent directly to Tunisie Colis by email at [email protected].

Only the customer who placed the order may submit a claim. The following information must be provided:

  • The complete order number
  • The reason for and circumstances of the claim

Customer service will provide a claim form to complete and return with a copy of the collection document signed by the carrier’s courier and the goods’ purchase invoice. For damaged goods, include photographs of the inside and outside packaging and the damaged item.

A damage claim must be made to the carrier within three working days after delivery. If the recipient notices damage during delivery, it must be recorded on the delivery document or the courier’s handheld device to facilitate communication between the insurer, platform and carrier.

The claimed goods must remain available for inspection at the delivery address, in the condition in which they were delivered.

Loss or damage claims are not valid in the following cases:

  • Second-hand goods
  • Unsuitable packaging that does not follow Tunisie Colis guidance

– Incorrect label

– No packaging

– Defective packaging

– Goods prohibited by law or Tunisie Colis rules

– Force majeure, such as natural disasters or civil war

Insurance cover for the claim is cancelled if the documents requested by Tunisie Colis are not supplied in full.

The French source text states that, once compensation is paid, the customer must return a properly dated and signed settlement receipt to Packlink Shipping SL.

Article 9 — Customer and recipient obligations

The recipient must check that the transported goods have arrived undamaged.

The customer must ensure that the order, packaging and labels comply with these terms and the carrier’s requirements to prevent damage. Packaging must support safe transport. A new cardboard box with suitable protection for the contents is recommended.

Claims may be refused if packaging does not meet the requirements.

The transport provider may refuse goods with unsuitable, defective or incomplete packaging.

The customer is responsible for damage caused to other goods by poor packaging of their own shipment and may be charged additional costs.

The sender must attach the address label correctly to avoid delivery confusion. Failure to follow this requirement may make the customer liable for resulting damage. Place the label on a flat surface so the barcode is not folded.

The customer acknowledges that Tunisie Colis and the chosen carrier are not responsible for expenses, losses, damage or costs arising from failure to meet the obligations in this article. The customer accepts responsibility for resulting costs, including transport and administration charges.

Article 10 — Ordering procedure

Orders are placed online only. The customer must complete the order form and follow these steps:

1. Open the website.

2. Enter the shipment’s origin, destination, contact details and full parcel information.

3. Choose the transport provider that best meets your needs.

4. Complete the form.

5. Choose whether to take out additional insurance.

6. Review the information and correct any errors.

7. Confirm the order by accepting the total price, including the delivery charges disclosed to the customer.

8. Before confirming, tick acceptance of these terms of sale and the selected transport provider’s terms.

An order confirmation is then sent to the customer’s email address.

Under Law No. 2000-83 of 9 August 2000, Tunisie Colis may refuse an order that does not comply with these terms, including prohibited goods or unsuitable packaging or labelling.

Article 11 — Prohibited goods

Article 12 — Payment

Offer validity and prices may vary as the website is updated.

The applicable rates are those shown on the website at the time the order is confirmed.

Orders are invoiced and payable in Tunisian dinars.

The customer must pay the charges specified in the transport contract for all agreed services.

The service and order-related charges are payable in full when the order is placed.

The customer may pay the transport contract’s charges using a payment method listed on the website.

The payment methods mentioned in these terms are bank card and bank transfer.

The customer must cover costs arising from reshipment, storage or special parcel handling. Additional charges may apply to unsuitable packaging or labels, or irregular shapes requiring special manual sorting.

Tunisie Colis will email the nature and amount of additional charges. They may be collected under an authorisation completed by the customer when placing the original order.

By providing bank card details, the customer authorises Tunisie Colis to charge the all-inclusive price.

The customer must confirm that they own the card and that the name on it is theirs. Payment details must be entered only in the payment provider’s secure form when payment is offered.

If payment cannot be collected, the order is cancelled.

Tunisie Colis may issue vouchers or discount codes for a specified period and use.

Enter a discount code when placing the order. Only one voucher may be used per order.

Expired unused vouchers cannot be exchanged for cash.

Tunisie Colis may suspend access to a customer account if payment is not made.

Article 13 — Additional charges

Additional charges are payable in the following circumstances:

1- Unsuccessful collection:

If the goods are not ready for collection as agreed, additional charges may apply. Amounts vary by transport provider and are set out in the selected provider’s terms.

2. Change of address:

Changing the collection or delivery address may incur additional charges. Contact the selected carrier to confirm the exact amount.

3. Weight, volume or parcel count different from the declaration:

The order price depends on the information supplied, including parcel count, volume, size, dimensions and weight. Differences between the actual goods and the declaration may lead to the parcel being held, returned or delayed, with additional charges.

4. Further delivery attempts:

Each further delivery attempt may incur additional charges under the selected provider’s terms. Consult the carrier’s terms for the exact amount.

Article 14 — Collection and delivery

1. Collection

Goods are collected at the precise address entered in the order, whether the sender’s address, a collection point or a post office. The customer may indicate a preferred collection date and time, but these are not always guaranteed.

If collection cannot take place under the confirmed conditions, Tunisie Colis or the provider will apply the selected carrier’s terms. Customers should check the provider’s service information and specific conditions.

If collection cannot take place because the customer does not meet the agreed arrangements, additional charges may apply.

2. Delivery:

Delivery is arranged for the date or period agreed when the order is placed. The first attempt is made to the address confirmed by the customer. Tracking may be available through the personal account. If delivery cannot take place, the customer is informed electronically or through the account of the new date. Delays may also be notified by correspondence. Consult the selected provider’s terms for the detailed arrangements.

If the recipient is absent and nobody else can receive the parcel, the customer is informed. By agreement, the goods may be returned, a further delivery attempted, or the parcel held by Tunisie Colis or the carrier for later collection.

The recipient should check the parcel’s condition on receipt.

If the carrier declares the parcel delivered, delivery is considered completed between the carrier and customer.

Article 15 — Personal data security

Tunisie Colis undertakes to respect users’ privacy and protect their personal data. The privacy policy explains how data is processed when users access the website, their privacy rights and the legal protection available.

Personal data must be used lawfully. Tunisie Colis may process customer data where necessary to perform a contract.

Some website links lead to external websites with different privacy policies. Check those policies before supplying personal information. Tunisie Colis is not responsible for their content or operation.

It may be wholly or partly released from liability if it proves that non-performance or defective performance was caused by the customer or by unforeseeable and unavoidable force majeure, such as war or a natural disaster.

If goods do not comply with the carrier’s and Tunisie Colis’s terms, Tunisie Colis is not responsible for damage, confiscation or loss.

Carrier delivery times are indicative, not fixed guarantees, and do not create liability for Tunisie Colis or the selected transport provider.

Article 19 — Governing law and jurisdiction

These terms are governed by Tunisian law and the contracting parties accept the jurisdiction of Tunisian courts. The French source also states that, if a dispute cannot be resolved, Tunisie Colis, the provider and the customer may assert their rights before the courts of their countries.
